Terms of Use

1. Agreement
These terms apply when you access or use MyKainga, create an account, publish a listing, request or book a space, or use related support services. If you do not agree, do not use the platform.
You must be at least 18 and legally able to enter contracts. You are responsible for your account and for promptly reporting suspected unauthorised use.
2. Marketplace role
MyKainga provides technology for hosts to advertise spaces and for guests to discover, request and book them. Unless expressly stated otherwise, MyKainga does not own, inspect, manage or lease listed spaces and is not a party to the separate accommodation or space-use agreement between a host and guest.
Hosts control whether a space is offered, subject to platform review and these terms. Guests must independently assess whether a listing suits their needs.
3. Listings and host duties
- Hosts must have authority to offer the space and comply with planning, tenancy, accommodation, tax, health, safety and other applicable obligations.
- Descriptions, photos, availability, pricing, access limitations and permitted use must be accurate and kept current.
- Hosts acting in trade must clearly meet their New Zealand consumer-law disclosure and conduct obligations.
- MyKainga may reject, pause or remove a listing that is incomplete, unsafe, misleading, unlawful or inconsistent with these terms.
4. Requests, bookings and payment
A request-only listing is not booked when a guest sends a request. If the host approves, the guest receives a limited payment window. An instant-book listing is not confirmed until secure checkout completes and the payment webhook records the booking as paid and confirmed.
Dates, availability and totals are recalculated on the server. Payment is processed by Stripe under Stripe’s terms. Do not pay a host outside the platform for a MyKainga booking unless MyKainga expressly authorises it.
Prices are displayed in New Zealand dollars unless stated otherwise. MyKainga currently records a 10% host platform fee in the booking ledger. Any guest-facing charge must be displayed before payment.
5. Cancellations and refunds
The cancellation policy shown on the listing when a booking is made governs eligible refunds, subject to law and any overriding written resolution. Refund calculations and Stripe refund requests are made through the platform. Refund timing after approval depends on the payment provider and banking network.
MyKainga does not promise an automatic “no questions asked” refund, escrow, or a particular bank-processing time.
6. Host payouts
Payouts are available only for eligible paid stays or non-refundable guest cancellations after the scheduled checkout date, less recorded platform fees and any refunds or adjustments. Hosts must have an enabled Stripe connected account. Stripe controls settlement, verification and bank-arrival timing. MyKainga may hold or reverse processing where fraud, disputes, refunds or legal obligations require review.
7. Prohibited conduct
- False listings, impersonation, payment fraud, review manipulation or misleading claims.
- Discrimination, harassment, threats, unsafe conduct or unlawful use of a space.
- Scraping, security testing without permission, account sharing, malware or attempts to bypass access controls.
- Publishing another person’s private address, identity, contact or payment information without authority.
8. Reviews, messages and reports
Reviews must relate to a completed paid stay and reflect genuine experience. Messages and reports must be accurate, relevant and lawful. MyKainga may moderate content and preserve records needed for safety, fraud prevention, support and legal compliance.
9. Safety and disputes
Users are responsible for personal safety and for following site rules and New Zealand law. In an emergency call 111. Use the report and support tools for non-emergency concerns.
Contact support first for booking or platform disputes. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded, including applicable rights under New Zealand consumer law.
10. Availability and liability
The platform may be changed, interrupted or unavailable. To the maximum extent permitted by law, MyKainga is not liable for indirect or consequential loss, lost profits, or a host’s or guest’s acts or omissions. Any limitation applies only to the extent allowed by law.
11. Privacy and intellectual property
Our Privacy Policy explains how personal information is handled. Users keep ownership of their content but grant MyKainga a non-exclusive licence to host, display and process it to operate, secure and promote the platform.
12. Changes, suspension and termination
We may update these terms prospectively and will post the effective date. Material changes should be communicated through the platform where practical. We may restrict or terminate access for risk, breach, unlawful conduct or operational reasons. Clauses that by nature should survive termination continue to apply.
13. New Zealand law and contact
These terms are governed by New Zealand law. New Zealand courts have non-exclusive jurisdiction, subject to mandatory consumer rights. For questions or notices, use the authenticated Support page.
